ここが知りたいRoHS指令

2008年9月26日に新電池指令（2006/66/EEC）が施行され、同日以降の市中に存在する電池の回収についてのお問い合わせをいくつか頂いていますので、情報を整理してみます。

A．新電池指令のポイント

対象は電池および蓄電池です。電池と蓄電池（電池類）とは化学的エネルギーの直接変換により発生した電気エネルギーの源泉装置で、非再充電電池および充電電池とがあります。

1．第4条　販売の禁止となる電池

（1）機器に内蔵されている電池を含めて、水銀含有率が0.0005wt％を超える電池
　 ただし、水銀含有率が2wt％未満のボタン電池は除く。

（2）機器に内蔵されている電池を含めて、カドミウム含有率が0.002wt％を超える携帯型電池
　 ただし、下記の携帯電池および蓄電池は除かれます。

• 非常灯を含む緊急時対応および警報システム
• 医療用具
• コードレス電動工具（2010年9月26日までに見直し）

2．第21条　表示

すべての電池、蓄電池（2次電池）、電池パックには分別回収のためのシンボルマーク（crossed-out wheeled bin）の表示が要求されます。

特定有害物質は水銀（Hg）、鉛（Pb）およびカドミウム（Cd）で、水銀は0.0005%、鉛は0.004%、カドミウムは0.002%を超えて含有する場合は、シンボルマークの下に元素記号を記載する義務があります。

特定有害物質を含有する電池は販売制限されますが、コードレス電動工具などは適用除外になっていますので、表示が必要になっています。

シンボルマークは電池への表示を原則とされ、電池本体に表示できない場合のみ消費者向けの包装容器に表示してもよいとされています。

表示は旧電池指令でも指令93/86/EECで表示義務が決まっていました。新電池指令では元素記号を記載する方式に一本化されました。EUの電池工業会がマーキングガイドを出しています。

B．新電池指令の論点

第6条2項により2008年9月26日から指令対応品以外は販売が制限され、市場から回収する義務が生じます。

2. Member States shall take the necessary measures to ensure that batteries or accumulators that do not meet the requirements of this Directive are not placed on the market or are withdrawn from it.

2008年9月26日以前に生産され市場に存在する表示が対応できていない電池類を回収することは大きな影響が生じます。このため、議会はすでに市場にある電池類は継続して販売できるように修正案を採択しました。第6条2項を次に置き換える提案です。

Member States shall take the necessary measures to ensure that batteries or accumulators that do not meet the requirements of this Directive are not placed on the market after 26 September 2008.

If batteries and accumulators that do not meet the requirements of this Directive are placed on the market after this date, they shall be withdrawn from it.

理事会の採択後にイギリス国内法The Batteries and Accumulators（Placing on the Market）Regulations 2008のGovernment Guidance Notesでは、2008年9月26日以前に販売した電池類は適用されないとしています。

Batteries lawfully placed on the market before 26 September 2008 and in compliance with the composition and labelling requirements set out in the current Batteries and Accumulators （Containing Dangerous Substances） Regulations 1994, may continue to be legally sold on, to end-users and others in the supply chain, despite not complying with the new requirements.

これら情報をまとめますと、2008年9月26日以前に上市し、市場に存在する電池類は回収することなく継続販売ができることになります。
